Unique Swiss Adventures GmbH, based in Zug, offers so-called ComicTrails in various regions of Switzerland. These are routes that have to be found with the help of puzzles. The riddles are coordinated and provide clues to the further course of the trail. The hikes take place on existing trails. The following General Terms and Conditions (GTC) govern the legal relationship between the organiser of the ComicTrails, Unique Swiss Adventures GmbH, and the participants.
CONTRACTUAL PARTNER
Unique Swiss Adventures GmbH, based in Zug (hereinafter referred to as the "Provider"), is the Provider of the ComicTrails. These GTC regulate the contractual rights and obligations between the Provider and the participants of a trail.
1. OFFER
The products and prices in the online shop are considered an offer. The offer is valid as long as the product can be found in the online shop and is in stock.
2. PRICES
The Unique Swiss Adventures GmbH is free to set the prices and can change them at any time. When ordering, the prices published on the website are decisive. The prices are given in CHF by default. Shipping and printing costs are calculated and shown separately from the offer price.
3. CONTRACTUAL PARTNER
The Provider is Unique Swiss Adventures GmbH with its registered office in Zug. The buyer - hereinafter referred to as participants - are persons who complete the ComicTrail alone or in a group.
4. CONCLUSION OF CONTRACT
Bookings can be made via the website www.comictrail.ch. By making a booking, the participant agrees to the terms and conditions of Unique Swiss Adventures GmbH and concludes a binding offer. The participant receives an automatically generated email as confirmation of the booking.
5. TERMS OF PAYMENT
The ComicTrail is payable immediately in the online shop by credit card or PayPal transfer. Purchased tickets cannot be refunded, even if the actual number of participants on the day of the event is smaller.
6. PREREQUISITES OF THE PARTICIPANTS
Participants must be able to complete a walk/hike. Average orientation skills and good health are required. No special local or regional knowledge is required. If necessary, the participant can consult the help page www.comictrail.ch/hilfe.
The trail is designed for children from the age of 8. Children may only participate if accompanied by their parent(s), guardian(s) or a caretaker who must be at least 18 years old. There must be at least one person in each puzzle team with a minimum age of 18 years.
6.1. MINIMUM EQUIPMENT:
For the use of a trail is the following is required:
at least one smartphone per puzzle team, able to receive and transmit data (applicable fees payable by the participants).
Also recommended:
One writing kit per puzzle team
Food, clothing and footwear suitable for the weather and season for completing the trail
7. LIABILITY AND INSURANCE
Participants complete the trail at their own risk. Insurance is the responsibility of the individual participants.
The ProviderProvider accepts no liability for direct or indirect personal injury or damage to property, even if this is due to the use of a trail or at a partner business.
The exclusion of liability also applies in the event of unlawful or negligent action by a partner company or an auxiliary person of a partner company. Liability of the Provider may apply in the case of an illegal act or gross negligence on the part of the Provider itself. The Provider cannot be held liable for the (lack of) third-party services.
8. DATA PROTECTION
When tickets are purchased, data is collected, stored and processed for order processing. This takes place within the framework of the legal provisions.
When visiting the website of the Provider, the IP address currently used by the phone, tablet, computer or similar device, the date and time, the browser type and the operating system of the computer as well as the pages viewed are logged, among other things. However, it is not possible and not intended to draw conclusions about personal data.
Personal data provided, for example, when placing an order or by e-mail (e.g. name and contact details) are only processed for correspondence with the customer and only for the purpose for which the data were provided. Personal data will only be disclosed to third parties to the extent necessary for the fulfillment of the business purpose. Disclosure may also take place if a legal obligation exists or the customer has expressly consented.
9. NEWSLETTER
By placing an order, making an enquiry or contacting the Provider, the Customer agrees that the Provider may send the Customer its electronic newsletter by e-mail. This newsletter can be cancelled at any time and free of charge with a mouse click via a corresponding web link in every e-mail sent.
10. COPYRIGHT
Copyright and all other rights to the ComicTrails, starting documents, plans, pictures, texts and other materials of the Unique Swiss Adventures GmbH remain in any case with the Provider.
Copying, duplicating, passing on and/or publishing of any kind of the ComicTrail idea, the starting documents and/or other products of the Unique Swiss Adventures GmbH is not permitted in any form and will be prosecuted to the full extent of applicable laws.
11. OTHER GENERAL PROVISIONS
11.1 CHANGES TO THE GENERAL TERMS AND CONDITIONS
The Supplier reserves the right to amend these GTC at any time and without notice when necessary. In each case, the version that can be viewed on the website at the time the contract is concluded and accepted before the order is placed shall apply.
11.2 PLACE OF JURISDICTION AND APPLICABLE LAW
The contractual relationship between the Provider and its Customers is subject to Swiss law. The exclusive place of jurisdiction for any resulting disputes is the registered office of Unique Swiss Adventures GmbH in Zug.
